2USER ACCOUNT CREATION & OPERATIONS
2.1 Registration Requirements
To access Sendalat, you must:
- Be at least 18 years old or of legal age in your jurisdiction
- Be a Canadian resident
- Complete our online registration form
- Provide valid personal and identification documentation
- Pass Know Your Customer (KYC) verification
- Pass anti-money laundering (AML) and counter-terrorism financing (CTF) screening
2.2 Verification Process
We conduct comprehensive verification including:

- Sanctions list screening
- Politically Exposed Persons (PEP) screening
- AML/CTF compliance checks

3YOUR RESPONSIBILITIES
3.1 User Obligations
You agree to:

- Employment status changes
- Source of funds information
3.1.2 Account Security
You are solely responsible for:

- Protecting your password and access codes
- All activities conducted using your account
- Immediately reporting unauthorized access or suspicious activity
3.1.3 Recipient Details
You must ensure that all recipient/beneficiary details are accurate and complete before submitting a transfer request. Once a transaction is submitted and confirmed, it cannot normally be reversed. Verify all details carefully before confirming.
3.1.4 Authorized Use Only
You agree:
- Not to act as an agent for third parties without express written permission
- To use the platform only for personal, lawful purposes
- Not to use malicious software or devices to interfere with platform operations
- Not to attempt unauthorized access or hacking
- To comply with all applicable laws and regulations
3.1.5 AML/CTF Compliance
You must comply with Sendalat's anti-money laundering and counter-terrorism financing programs. You certify that:
- Funds come from lawful sources
- You are not engaged in illegal activities
- Transactions comply with all applicable sanctions laws
- You are not listed on any sanctions lists
3.1.6 Wallet Funding
You will fund your wallet account only using the registered name on the account. Transfers from third-party accounts are not permitted.
4OUR RESPONSIBILITIES
4.1 Service Commitments
We commit to:
4.1.1 Up-to-Date Information
We provide current information including exchange rates, transaction receipts, and operating hours. However, we are not liable for inaccuracies resulting from incomplete or incorrect information provided by users.
4.1.2 Reasonable Due Diligence
We observe reasonable due diligence and duty of care in processing transactions in our operating regions.
4.1.3 Timely Processing
We make reasonable efforts to process transfers promptly. Delays, failures, or errors may occur due to:
- Bank processing delays
- Technical issues from third-party providers
- Incorrect information provided
- Recipient bank security questions
- Currency availability variations
- Business hours differences
- Factors beyond our control
4.1.4 Transaction Review
We reserve the right to accept, decline, or cancel transactions where we suspect incorrect information, AML/CTF concerns, or regulatory issues. You will be notified of such actions, and refunds will be processed where legally permitted.
5WARRANTIES & LIABILITIES
5.1 Limitation of Liability
Sendalat shall not be liable for delays, failures, or errors arising from:
- System failures or technical issues (ours or third parties')
- Scheduled maintenance or system repairs
- Third-party actions or omissions
- Factors beyond our control
- Compliance with applicable law
5.2 Service Warranty
Sendalat services are provided "as is" and "as available" without warranties of merchantability, fitness for purpose, or accuracy. We disclaim all implied, express, or statutory warranties except as explicitly stated.
5.3 User Negligence
Sendalat is not responsible for losses resulting from:
- Compromised passwords or login credentials
- Unauthorized account access due to user negligence
- Incorrect recipient information provided by you
- Failure to verify transaction details
5.4 Compensation
If we breach these terms and conditions resulting in material loss, we will make reasonable efforts to restore you to your previous position. All compensation claims must be supported by relevant documentation.
6TRANSACTION CANCELLATION & REFUNDS
6.1 Non-Reversible Transactions
All transactions are automated for your convenience. Once submitted and confirmed, transactions cannot be cancelled or reversed. In rare cases, we may attempt to lodge a reversal request with the beneficiary bank, but this is not guaranteed.
6.2 Wallet Refunds
Refunds or cancellations of funds in your wallet may incur charges as outlined in our fee schedule.
6.3 Suspicious Activity
We may suspend or refuse transactions where:
- We suspect fraudulent or suspicious activity
- We believe the service is being used for illegal purposes
- The transaction appears to violate sanctions or AML/CTF laws
- We suspect unauthorized account access
You will be notified of such actions pending investigation conclusion.
7TERMINATION OF SERVICES
7.1 Termination Rights
Either party may terminate this agreement at any time without cause or prior notice. Neither party shall be liable for such termination.
7.2 Grounds for Termination
Sendalat may terminate your account if:
- You breach any provision of these Terms and Conditions
- Your activity is disruptive or fraudulent
- You attempt to breach platform security
- You engage in unauthorized administrative access or hacking
- You use malware or destructive programs
- We suspect suspicious or illegal activity
- Required by law or regulation
8PRIVACY & DATA PROTECTION
8.1 Information Protection
Sendalat protects your personal information through industry-standard security measures. As a regulated entity, we may share personal information with:
- FINTRAC and other regulatory bodies
- Law enforcement agencies
- AML/CTF verification service providers
- Credit bureaus and verification companies
- Partners required for account opening and verification
8.2 Data Retention & FINTRAC Compliance
We are mandated by FINTRAC to maintain compliance by:
- Maintaining financial records
- Storing customer identification data
- Reporting certain transactions
- Conducting ongoing customer due diligence
By agreeing to these terms, you consent to us storing your information for business and regulatory compliance purposes.
9COMPLAINTS & DISPUTE RESOLUTION
9.1 Complaint Process
To file a complaint about any aspect of our service:

- Provide detailed information about your complaint

- Allow us to investigate within our service level agreement timeframe

10INDEMNIFICATION

By accepting these terms, you agree to indemnify, defend, and hold harmless Sendalat and related parties from any liabilities and claims arising from:
- Your breach of these Terms and Conditions
- Your negligence or actions
- Unauthorized use by you or authorized users
- Your violation of any law or third-party rights
11REWARDS & PROMOTIONAL OFFERS
11.1 Coupons & Rewards
Sendalat provides reward incentives to customers in the form of coupons at our discretion. Terms and conditions of such offers will be stated when rolled out.
12GOVERNING LAW & JURISDICTION
12.1 Applicable Law
These Terms and Conditions are governed by the federal laws of Canada and the laws of the Province of Ontario. The parties submit to the jurisdiction of the courts located in Ontario.
12.2 Enforcement
Failure to enforce any provision does not constitute a waiver of such right or provision.
